Wattbike USA - Terms of Service 

Before placing an order with us, you should read these Conditions carefully. If you require any changes to these Conditions, pleaserequest that they be put in writing. By making a purchase, you agree to be bound by these terms. 

1. DEFINITIONS 

In these Conditions, the following terms have the meanings set out below, unless the context requires otherwise: 

  • 'Conditions': These terms and conditions. 

  • 'Contract': Any agreement for the sale and purchase of Goods under these Conditions. 

  • 'Cooling Off Period': The 30-day period described in Condition 8.3.1, during which you may cancel the contract. 

  • 'Delivery Address': The address for delivery of the Goods in the United States, as set out in the Order Acknowledgment. 

  • 'Goods': All products supplied by us under the Contract. 

  • 'Mainland United States': Excludes Hawaii and Alaska. 

  • 'Notice of Cancellation': A written notification of your intention to cancel the Contract. 

  • 'Order Acknowledgment': Our written confirmation of acceptance of your order. 

  • 'Price': The price for the Goods as specified in the Order Acknowledgment. 

  • 'Site': The websitelocated atwww.us.wattbike.com. 

  • 'Working Day': Any day from Monday to Friday, excluding statutory holidays or public holidays. 

  • 'We', 'Us', or 'Our':Wattbike Limited, a company registered in England and Wales, with company number 5554245 and VAT registration GB 115081157. 

  • 'You' or 'Your': The person or entity who has accepted these Conditions. 

Additional Definitions 

  • Statutory references are updated to include applicable amendments, and terms in the singular include the plural. 

2. BASIS OF CONTRACT 

2.1. These Conditions apply to all Goods purchased by you from us. 

2.2. The Contract applies only to Goods purchased within the Continental United States (excluding Alaska and Hawaii). 

2.3. The Contract is formed when we issue an Order Acknowledgment confirming acceptance of your order. 

2.4. Any promises or claims about the Goods not made by us, our employees, or agents are not part of the Contract. 

2.5. We may correct errors or omissions in documents without materially affecting the Contract. 

2.6. We may alter the Goods to comply with legal requirements, provided itdoesn't significantly change their nature or Price. 

2.7. If Goods are unavailable, we will contact you to offer alternatives or cancel the order. If we can't reach you within 28 Working Days, the Contract iscancelled, and you will be refunded any amounts paid. 

2.8. Wattbike products are available for purchase in the U.S. (excluding Alaska), as well asGreat Britain,Ireland and Australia. 

3. PRICE 

3.1. The Price is the amount displayed on the Site when your order is received. 

3.2. If an error in pricing is discovered, we will notify you and allow you to reconfirm the order at the correct price or cancel. If wecan't contact you or if youdon't respond within 10 Working Days, the order will becancelled, and you will be refunded. 

3.3. All prices include applicable sales taxes, unless otherwise stated. 

3.4. Delivery charges for mainland U.S. standard delivery are additional, and prices will be displayed during order placement.Additional charges apply for non-Working Day deliveries 

4. PAYMENT 

4.1. Payment for Goods is due at the time of order placement and can be made using credit or debit cards, including MasterCard, Visa, Amex, and Discover. 

4.2. Payments will be accepted only in U.S. Dollars. 

5. PACKAGING 

5.1. We decide the packaging of Goods. We are not obligated tocomply with any special requests related to packaging.  

5.2. If a delivery is rejected due to packaging damage, but the Goods inside remain undamaged, a redelivery charge may apply. 

6. DELIVERY 

6.1. Delivery occurs when Goods are delivered to the Delivery Address. 

6.2. We aim to deliver Goods by the date specified in the Order Acknowledgment but are not responsible for delays beyond our control. If delivery is delayed for over 30 Working Days, you may cancel the Contract and claim reasonable losses. 

6.3. We may deliver Goods in instalments. 

6.4. If you fail to accept delivery, we may charge for storage and redelivery, including the cost of repeat deliveries. 

6.5. You must notify us of any damages or shortages within 7 Working Days of delivery. 

6.6. On delivery, it is your responsibility to ensure the number of packages received matches the number signed for. 

6.7. If you cancel the order when the delivery has already been dispatched from our warehouse, you will be responsible forany delivery or return costs incurred by Us

6.8. Standard or box delivery is to threshold only.  If residing in an apartment, this is to the ground floor threshold or foyer. The delivery does not include going up steps to any apartment. If you were needing a delivery to a room or choice. We may be able to accommodate this via our delivery partner for an additional fee. Please contact us directly to request this. 

7. RISK AND TITLE OF GOODS 

7.1. The risk of damage to or loss of Goods transfers to you upon delivery to the Delivery Address or when we attempt delivery if you refuse to accept it. 

7.2. Ownership of the Goods transfers to you upon delivery. 

8. CANCELLATIONS 

8.1. You may cancel the Contract within 30 days of delivery (except for personalized or customized items) under the Cooling Off Period. 

8.2. To cancel, you must provide a Notice of Cancellation and return the Goods at your own expense, or we may arrange pickup (fees apply). 

8.3. We will refund the full price within 30 days from your Notice of Cancellation, subject to the conditions outlined below. 

8.4. If you fail to return the Goods or return them at our expense, we may deduct collection fees or other reasonable costs from your refund. 

8.5. If Goods are returned damaged or missing components, we may seek compensation for damages, which will be deducted from your final refund 

8.6. All bikes must be returned in their original, unused condition, with all accessories, packaging, and documentation intact. Any bike returned showing signs of use, wear, or damage (including but not limited to scratches, dents, alterations, or any other condition that may impact the resale value) will be subject to a deduction from the total refund amount. The amount deducted will reflect the cost of restoring the bike to its original condition, or the reduction in resale value, asdetermined by our team. 

8.7. We reserve the right to assess the bike’s condition upon return and apply the appropriate refund adjustments based on our findings. 

8.8. If you cancel the order after we have dispatched the product, we reserve the right to charge you any fees incurred with dispatching the bike and returning the bike to our warehouse.   

9. COMPLAINTS, WARRANTIES, AND RETURNS

9.2. We provide a warranty forWattbike products against defects for the periods specified: 

               1. New Wattbikes: 2 years for the frame, 1 year for the monitor, and 6 months for consumables. 

               2. Reconditioned: 1-year warranty for moving parts, 6 months for consumables. 

9.3. Warranty claims must be reported as soon as possible, and within 10 days of the discovery, and goods may need to be returned for inspection. 

9.4. If a product is found defective, we may replace it or refund the purchase price, or the current resale price, dependant on time owned 

9.5. Failure to follow instructions or unauthorized repairs voids the warranty.

10. LIABILITY 

10.1. We are not liable for any indirect or business-related losses unless caused by our negligence. 

10.2. We will not be liable for losses not foreseeable at the time the Contract was made. 

11. FORCE MAJEURE 

11.1. We are not liable for any delay or failure to perform our obligations due to events outside of our control, such as strikes, natural disasters, or government actions. 

12. ASSIGNMENT 

12.1. We may assign the Contract to any third party. 

12.2. You cannot assign the Contract without our written consent. 

13. THIRD-PARTY RIGHTS 

13.1. No third party may enforce the terms of the Contract unless expressly stated. 

14. SEVERANCE 

14.1. If any part of these Conditions is found to be invalid, the rest remain in effect. 

15. WAIVER 

15.1. Failure to enforce any right under this Contract does not constitute a waiver of that right in the future. 

16. CUMULATIVE REMEDIES 

16.1. Our rights and remedies are cumulative, and the use of one does not exclude others. 

17. GOVERNING LAW ANDJURISDICTION 

17.1. This Contract is governed by the laws of the United States. Any disputes will be resolved in the U.S. courts. 

18.PROMOTIONS 

Promotional codes: 

18.1. Can only be applied to full-price items. 

18.2. Cannot be combined with other discounts. 

18.3. Cannot be redeemed for cash. 

18.4. Refunds on returned products will be for the value paid, including any discounts.
